The sole issue raised in this appeal is whether the common law doctrine of parental tort immunity bars an action for contribution against the parents of an injured minor child. The minor plaintiff, Joseph Moon, was riding his bicycle when he was struck by an automobile driven by the defendant, Roy Thompson. A lawsuit for personal injuries was filed against the defendant on behalf of the plaintiff by the plaintiffs father. The defendant answered the complaint and filed a third-party action for contribution against the plaintiffs parents. The trial court dismissed the third-party complaint, finding that the parental tort immunity doctrine barred an action for contribution against the plaintiffs parents. The defendant now appeals the trial courts order dismissing his third-party complaint.
